Context and Objectives
The Regulation (EU) 2025/40 of the European Parliament and of the Council, adopted on 19 December 2024, aims to establish harmonized rules for packaging and packaging waste within the European Union. The main objective is to reduce the environmental impact of packaging and to improve the management of packaging waste, fostering a circular economy and reducing barriers to the internal market for products.

- Scope:
- The regulation applies to all types of packaging and packaging waste, regardless of the materials used, and to all waste packaging, regardless of the context in which these packages are used or the origin of the packaging waste (industrial, commercial, household, etc.).
- It does not apply to packaging used for the transport of dangerous goods as per Directive 2008/68/EC.
- Essential Requirements:
- Packaging must be designed and manufactured to minimize the presence of hazardous substances and to ensure it can be safely transported, used, and disposed of.
- Packaging must be recyclable and, where possible, compostable.
- Packaging must contain a minimum percentage of recycled content, with specific targets for plastic packaging.
- Packaging must be designed to minimize waste and excess material.
- Reusable packaging must be designed to withstand multiple uses and to be returned to the system efficiently.
- Labeling and Information:
- Packaging must be clearly labeled to inform consumers about proper disposal and recycling methods.
- Reusable packaging must be clearly identified to encourage its reuse.
- Compostable packaging must be labeled to inform consumers about composting methods and to prevent contamination of recycling streams.
- Extended Producer Responsibility (EPR):
- Producers are responsible for the entire lifecycle of packaging, including design, production, and end-of-life management.
- Producers must ensure that packaging can be safely recycled and that hazardous substances are minimized.
- Producers must provide clear and accessible information to consumers about the recyclability and disposal of packaging.

- Packaging for plant protection products must be designed to be safe for both the plants and the environment (minimizing environmental impact and to ensure safety for users).
- It should be recyclable and, if possible, compostable to reduce waste and environmental impact .
