Recently, the Federal Official Gazette brought significant news for the agricultural sector: Joint Ordinances No. 02 and No. 03, resulting from collaboration between the Ministry of Agriculture and Livestock (MAPA), the National Health Surveillance Agency (ANVISA), and the Brazilian Institute of the Environment and Renewable Natural Resources (IBAMA). These measures aim to streamline and ensure the approval of registration processes and post-registration changes for pesticides and related products.
Joint Ordinance SDA/MAPA – IBAMA – ANVISA No. 2/2023: Simplifying the Amendment Process:
This ordinance establishes crucial guidelines for modifications to pesticide registrations, including changes to Technical Products, Pre-Mixtures, formulators, handlers, and packaging. The Secretary of Agricultural Defense, Carlos Goulart, highlights that over 70% of change requests align with this norm, seeking procedural simplifications for requests with low toxicological, environmental, or agronomic impact. The expectation is a considerable reduction in analysis timelines, providing optimized efficiency in administrative procedures.
Joint Ordinance SDA/MAPA – IBAMA – ANVISA No. 3/2023: Strategic direction for pending processes:
This measure establishes specific procedures for the distribution of pending processes for the registration of equivalent technical products, pre-mixtures, and formulated pesticide products. The aim is to comply with Article 3 of Decree No. 10.833/2021, which sets a 4-year deadline for the analysis of processes filed before it came into force. Carlos Goulart emphasizes that these procedures aim to avoid constant legal actions in registration processes, ensuring compliance with legal deadlines.
Challenges and opportunities to optimize product registrations in Brazil:
Around 1,400 processes filed before October 2021 await analysis, with 800 of them being “clone” products (identical to other registrations). The current legislation limits analysis in chronological order, but the expectation is that the new approach will allow for a more effective evaluation. The expansion of pesticide offerings, as a result of this speedier registration process, promotes competitiveness in the market, lower prices, and a greater variety of options for farmers in pest control.
It is important to note that, despite the increased availability, technical analysis and prescription by qualified professionals remain essential requirements. All registered products will be rigorously examined and approved by the responsible bodies, following scientific criteria and international best practices.
